| DUI / Traffic Offenses |
 |
DUI and other serious traffic offense charges can result in long-term consequences physically, financially, socially and emotionally. It is crucial that you obtain legal counsel from an experienced attorney. The Law Offices of Robert H. Ellis strive to get their clients through these difficult circumstances and to avoid the harsh penalties now being assessed by the State of Florida. Our office is sensitive to the costs you may incur due to DUI charges. We strive to keep our rates reasonable and affordable. You can phone 24/7 and speak directly with an attorney rather than a secretary. If you have been arrested for a DUI, you must act fast. Don’t let a mistake ruin your life. Before you take any action, make sure you consider all of your legal rights.
10 Things You Should Know About a DUI Arrest
- You have only 10 days from date of arrest to contest your driver’s license suspension.
- You are responsible for any lapse in communication between you and the licensing bureau. Make sure you do not miss your court date despite the confusing forms you receive.
- You have the right to thoroughly discuss all aspects of your DUI charge with an attorney before you plead guilty or no contest.
- Police are required to follow certain procedures; failure to do so can result in a violation of your civil rights and a possible dismissal of charges.
- Was a breath, blood or urine test legally taken?
- Were you advised of your right to refuse a breath test and the consequences if you do so?
- Did the arresting officer have probable cause to arrest you?
- If convicted of a DUI, you will have a permanent criminal record for the rest of your life and could be sentenced to jail even in a first offense.
- Amongst other penalties, a second offense DUI conviction could result in a mandatory jail sentence; a third offense DUI could result in a felony conviction and up to five years imprisonment.
- If you are not a U.S. citizen, a DUI conviction could result in deportation.

KNOW YOUR RIGHTS
Have you been arrested? Remember, no act is considered a crime if it has not been previously established as such either by statute or common law. Likewise, all statutes describing criminal behavior can be broken down into various elements that must be carefully examined in any defense. If you have been arrested and charged with a crime, you need the help of a highly skilled attorney. Unlike civil cases, where the plaintiff needs to show a “preponderance of the evidence,” prosecutors in criminal cases must prove each and every element of the crime “beyond a reasonable doubt” to yield a conviction. The Law Offices of Robert H. Law are committed to giving each case the time and attention required for thorough investigation and a comprehensive defense. We will fight for you. |

| Employment Law |
 |
Employment law is a broad area covering many areas of employer/employee relationships. Discrimination in employment, workplace safety, worker’s compensation, and unemployment compensation are common areas of litigation among employers and employees. There are literally thousands of state and federal statutes, administrative regulations and judicial decisions that reflect employment issues. Employment is a lifeline for most individuals. | Worker’s Compensation |
 |
Federal and State Statutes establish a framework for most employment issues. Worker’s Compensation laws, designed to ensure that employees injured or disabled on the job are provided with fixed monetary awards, are meant to eliminate the need for litigation. In some circumstances, laws also provide benefits for dependents of workers who are killed in work-related accidents or illnesses. Likewise, employers are also protected by laws that limit the amount an injured employee can recover from an employer. To protect your right to a reasonable Worker’s Compensation award, call the Law Offices of Robert H. Ellis. Mr. Ellis has obtained favorable results for both employees and employers at trial before the Judge of Compensation Claims. Experience counts.

| Civil Rights |
 |
Do you believe that you have had your civil rights violated? Do you believe you have been a victim of discrimination? The law defines a “civil right” as an enforceable right or privilege which, if interfered with by another, gives rise to an action or injury. Most generally, civil rights such as speech, press, assembly, the right to vote, involuntary servitude, and equality in public places are protected by federal law and the U.S. Constitution. Within these protected rights, discrimination may be an issue if an individual civil right has been denied or interfered with based upon race, sex, religion, age, disability or national origin. Mr. Ellis has experience representing both discriminated parties and state agencies including extensive experience with claims under 28 USC 1983. Call the Law Office of Robert H. Ellis to discuss how we can help you.
